Public comment invited on giving victims of institutional abuse more time to seek damages

As part of the NSW Government response to inquiries into institutional child abuse, public submissions are now invited on the legal time limit allowed to victims of institutional abuse to sue for damages.

Written submissions can be sent by post or email to the Department of Justice up to 10 March 2015 as detailed below.

A discussion paper has been made available on whether to amend the Limitation Act 1969 to amend or remove statutory limitation periods. The discussion paper raises issues of interest to all survivors of child sexual abuse and is not confined to those abused in institutions or organisations.

The Royal Commission into Institutional Responses to Child Sexual Abuse uncovered widespread claims about abuse and, as well, the legal barriers survivors face in pursuing justice many years after the event.

Public consultation will begin on Friday 23 January 2015 and will close on Tuesday 10 March 2015.
